Terms of Service

1. About these terms

These Terms of Service ("Terms") are a binding agreement between you and Kupiša, s. r. o., a company registered in the Slovak Republic with its registered office at Budatínska 3230/16A, 851 06 Bratislava, Company ID: 55804951 ("DashboardWP", "we", "us"), which operates the DashboardWP service available at dashboardwp.com and app.dashboardwp.com (the "Service").

By creating an account, connecting a site or otherwise using the Service, you accept these Terms. If you use the Service on behalf of a company or a client, you confirm that you are authorised to bind them, and "you" includes them.

If you do not agree with these Terms, do not use the Service.

2. The Service

DashboardWP is a central dashboard for managing WordPress sites. You connect a site by installing the DashboardWP Connector plugin (the "Connector") on it; the dashboard then lets you run updates of WordPress core, plugins and themes, create and restore backups, monitor uptime, run security and malware scans, review activity, log into wp-admin with one click, and use related features we add over time.

Available features depend on the plan each site is on. Features marked as upcoming ("Soon") are not a commitment: they may change or never ship.

3. Your account

You must be at least 18 years old, or the age of legal majority where you live, to use the Service.

  • Provide accurate account information and keep it up to date.
  • Keep your password and access tokens confidential. You are responsible for everything done under your account.
  • Tell us at hello@dashboardwp.com immediately if you suspect unauthorised access to your account.

Because the Service can make far-reaching changes to your sites (including restoring backups and logging into wp-admin), protecting your DashboardWP account is critical. We may add further protections such as two-factor authentication and may require them for certain features.

4. Your sites and your authority over them

You may only connect sites that you own or are expressly authorised to manage. If you manage sites for clients, obtaining and maintaining that authorisation (including for backups of their data, security scans and administrative access) is your responsibility.

Every operation the Service performs on a site, whether you trigger it manually or configure it to run on a schedule, is performed on your instruction and under your responsibility. This includes updates, installing and removing plugins and themes, restores that overwrite existing data, remediation actions that delete or quarantine files, and one-click administrator logins.

If you use the automatic Connector installation, the administrator credentials you provide are used once, to install and activate the Connector, and are not stored.

5. The Connector plugin

We grant you a non-exclusive, non-transferable licence to install and use the Connector on sites you connect to the Service, for as long as these Terms apply to you.

  • Keep the Connector reasonably up to date; some features require a minimum Connector version to work or to work safely.
  • Do not modify, circumvent or interfere with the Connector's authentication and request-signing mechanisms.
  • Uninstalling the Connector disconnects the site; features that depend on it stop working.

6. Backups and restores

Backups you create are stored on infrastructure operated by our cloud storage provider. Backups remain your data (see section 11) and are deleted when you delete them, when the associated site is removed, or when your account is closed.

Backups are a best-effort snapshot of what your site's hosting environment made available at the time. You are responsible for periodically verifying that your backups exist and can be restored, and for keeping independent copies of data you cannot afford to lose. The Service is a management tool, not an archival or compliance storage service, and must not be your only backup.

Restoring a backup overwrites current data on the target site. Where offered, a safety backup taken before a restore is a convenience, not a guarantee.

7. Uptime monitoring, security and malware scanning

Monitoring and scanning features are informational tools that work on a best-effort basis. We do not guarantee that every outage will be detected or reported within any particular time, that every vulnerability, misconfiguration or piece of malware will be found, or that a clean scan means a site is secure. Scan results, scores and recommendations are not a security audit and do not replace professional incident response.

Remediation actions offered by the Service (such as deleting or quarantining files or restoring core files) modify your site and are executed on your instruction. Review findings before acting on them.

8. Acceptable use

You agree not to:

  • use the Service in violation of applicable law, or to manage, scan or access sites without the authority described in section 4;
  • use the Service to store, distribute or conceal malware or other unlawful content;
  • probe, breach or circumvent the Service's security, rate limits or authentication, or access other users' accounts or data;
  • overload or disrupt the Service, or use it in a way that degrades it for others;
  • resell, sublicense or offer the Service as your own without a separate written agreement with us;
  • reverse engineer or copy the Service or the Connector except to the extent applicable law expressly permits.

If you believe you found a security vulnerability in the Service, please report it to security@dashboardwp.com rather than exploiting it.

9. Plans, billing and taxes

The Free plan is free and does not require payment details. Paid plans are priced per site per month, as published on our pricing page at the time of purchase. Mixing plans across sites on one account is supported; each site is billed according to its own plan.

  • Subscriptions renew monthly until cancelled.
  • Mid-cycle upgrades, downgrades and plan changes are prorated: you pay only for the days a site actually spends on a paid plan.
  • Prices may change; we will give you at least 30 days' notice, and a new price applies from your next billing cycle. If you do not agree, cancel before it takes effect.
  • Prices are stated exclusive of VAT and similar taxes unless said otherwise; applicable taxes are added based on your billing details.

10. Cancellation and refunds

You can cancel a site's paid plan at any time, with no notice period: the site simply drops back to the Free plan and stays connected, and any unused prepaid time is handled by proration as described above.

14-day money-back guarantee: if you are not satisfied, we will refund the first payment for a site's paid plan in full, provided you request it at hello@dashboardwp.com within 14 days of that first payment.

If you are a consumer in the European Union, you have a statutory 14-day right of withdrawal from a distance contract. By starting a paid plan you request that the service begins immediately; where you have expressly consented to immediate performance, the statutory right may be limited accordingly; our 14-day money-back guarantee applies in any case. Your mandatory consumer rights remain unaffected.

11. Your content and data

Your sites, their content, your backups and the data collected from your sites remain yours. You grant us the rights needed to host, process, transmit and display that data solely to provide and improve the Service. We acquire no other rights to it.

You are responsible for the content of the sites you connect and back up, including having a lawful basis for any personal data they contain.

How we handle personal data is described in our Privacy Policy. When your account is closed, we delete your data, including backups, within 30 days, except where law requires us to keep it longer.

12. Our intellectual property

The Service, the Connector, the DashboardWP name, logo and mascot, and everything else we make available (except your data and third-party components under their own licences) are and remain our property or that of our licensors. These Terms grant you no rights in them beyond the limited right to use the Service.

13. Third-party services

The Service relies on third parties: cloud hosting and storage providers, the WordPress.org APIs for update packages and directory data, vulnerability intelligence data, and optional sign-in with Google. Their availability is outside our control, and their own terms may apply to you where you interact with them directly (for example, Google sign-in). We are not responsible for third-party services.

14. Availability and changes to the Service

We work to keep the Service available and dependable, but we do not promise uninterrupted or error-free operation, and no service level agreement applies unless we have signed one with you separately. Maintenance, updates and factors outside our control may cause interruptions.

The Service evolves: we may add, change or retire features. If we materially reduce a paid plan's core functionality, we will give you reasonable advance notice so you can cancel first.

15. Suspension and termination

You may stop using the Service and close your account at any time.

We may suspend or terminate your access if you materially breach these Terms, if we are required to by law, or if your use creates a security or operational risk to the Service or to others. Where reasonable, we will notify you and give you a chance to fix the problem first.

On account closure, section 11 applies to your data. Sections that by their nature should survive (including 11, 12 and 16-20) survive termination.

16. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including fitness for a particular purpose and non-infringement. Managing live websites inherently carries risk (an update, restore or remediation can break a site), and the Service's safety features reduce that risk but cannot eliminate it. Nothing in this section limits warranties or guarantees that cannot lawfully be disclaimed, including mandatory consumer guarantees.

17. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect or consequential damages (including lost profits, lost revenue, lost data on your sites, or the cost of substitute services), and our total liability arising out of or related to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim, or $50 if you paid nothing.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for intentional misconduct, gross negligence, or death or personal injury, or your mandatory rights as a consumer.

18. Indemnity

If you are not a consumer, you will indemnify us against third-party claims arising from your breach of these Terms, in particular from connecting, scanning or operating on sites without proper authority, or from the content of sites you connect.

19. Changes to these Terms

We may update these Terms as the Service and the law evolve. For material changes we will notify you, by email or in the dashboard, at least 14 days before they take effect. If you do not agree with a change, cancel and stop using the Service before it takes effect; continued use after that date means you accept the updated Terms. The "Last updated" date above always reflects the current version.

20. Governing law and disputes

These Terms are governed by the laws of the Slovak Republic. If you are a consumer residing in the European Union, you additionally enjoy the mandatory consumer protections of the country where you live, and nothing in this section deprives you of them.

Disputes will be resolved by the competent courts of the Slovak Republic, unless mandatory consumer rules give you the right to sue, or be sued, where you live. EU consumers may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr and are entitled to seek alternative dispute resolution before recognised Slovak ADR bodies.
